Restaurant sends $48 birthday dessert to the wrong table, then tries to make customer pay for its mistake: 'I never ordered it'

  • I was out with my wife and another couple at a fairly nice Italian place last weekend. About halfway through dinner, the staff came over singing "Happy Birthday" with a huge dessert platter covered in sparklers and set it down in front of me.
  • Problem is, it wasn't my birthday.
  • I immediately told them they had the wrong table, but they were in full performance mode and basically ignored me. The whole restaurant was clapping, someone recorded it, and one of the servers even put a birthday crown on my head.
  • Afterward I told the waitress again that there'd been a mistake. She apologized and said the actual birthday party was seated in the back, but since the dessert had already been served and I'd blown out the candle, they couldn't give it to the other table.
  • Fine. Whatever.
  • Then the bill came, and there was a $48 "Celebration Dessert Experience" charge.
  • I told the waitress I wasn't paying for something I never ordered. She agreed it was a mistake and got the manager.
  • The manager said that while they acknowledged the error, I had "participated in the experience" and had eaten most of the dessert (which all four of us shared because they literally left it on the table). He offered to reduce the charge to $25.
  • I refused.

  • Eventually they removed it, but not before the manager loudly said, "Some people are willing to ruin a server's night over forty-eight dollars."
  • Here's where it gets awkward.
  • As we were leaving, the actual birthday party stopped us. Apparently they'd overheard everything. The birthday guy said I should've just paid for it because "the staff was trying their best" and because they never got their dessert due to the mix-up.
  • My wife thinks I was right not to pay, but our friends say we should've just eaten the cost and moved on since everyone makes mistakes.

  • WasWawa NTA. If the restaurant really wanted to make it right, they would have repeated the performance for the right people. The first thing they should have done was comped the dessert to your table with an abject apology. Once the cake had been served to your table, they couldn't reserve it anywhere else and their only other option was to throw it away or give it to the servers.
